Terms and Conditions

1. Application

These terms and conditions for the “Vinsajten.com” and “Berevita.com” web shops by Vinsajten GmbH, Holm 38, D 24937-Flensburg (in the following called “seller”) apply to all orders placed by private consumers (in the following called “customers”) regarding the goods, presented by the seller. We object to the inclusion of own conditions by the customer, unless otherwise agreed. 
Customer as defined by these terms and conditions is any natural or legal person, who completes a transaction with a purpose that cannot be linked to the self-employed or industrial activity of this person. Entrepreneur as defined by these terms and conditions is any natural or legal person or company with legal capacity that completes a transaction, exercising self-employed or industrial activity.

2. Conclusion of contract

2.1 The product presentations, shown by the seller in the online shop do not represent binding offers by the seller but are shown so the customer can make a binding offer on them.

2.2 The customer can give his offer using the order system, integrated in the shop. For this purpose, the customer selects the products he wants to order by clicking on “Buy“ and thereby puts the products into the shopping cart. Products can be removed or added from the shopping cart at all times. With a click on “To checkout“ the customer gets to the next step of the order process, where he is asked to enter his personal data and to confirm the order. By clicking on “Confirm order“ the customer submits a legally binding offer for the goods in the shopping cart.

2.3 The seller can accept the offer by sending an order confirmation by letter, fax or email or confirm the order by delivery of the goods within 1-2 days after the order. The seller is allowed to reject the offer.

2.4 Order processing and all contact normally happen via email and an automated order handling process. The customer has to make sure that the email address he entered during the order process is correct. So that he can receive the emails the seller sends. If the customer uses a spam filter he has to make sure that he can receive the emails sent by the seller and third persons, assigned by the seller.

2.5 The period for accepting the offer starts at the same day as the customer sends his offer and ends at the end of the second day after the customer has sent the offer.

2.6 When the customer orders alcoholic beverages he confirms that he is of legal drinking age and has to make sure that he or another full aged person assigned by him, is allowed to receive the goods.

3. Specifications on delivery and transport

3.1 The delivery address provided by the customer during the order process is decisive.

3.2 The delivery to places outside from Germany has to be ordered separately. For this purpose the seller provides two alternatives on the site.

3.3 Should the transport company have to send the goods back to the seller, because it was not possible to deliver the goods, the customer bears the costs for the unsuccessful delivery. This does not apply, if the customer exercises his right of withdrawal by rejecting to accept the package, when it is not his fault that it was impossible to deliver the goods.

4. Reservations

We reserve the right to distribute images and texts on our website incl. printed material. In exceptional cases the wines’ vintage can differ on the packing slip of the producer. The goods belong to the seller until they are completely paid.

5. Prices and Payment

5.1 The prices shown by the seller are final prices, which mean they contain all price components, incl. German VAT. Additional costs for delivery and transport are shown in the individual product presentation.

5.2 For deliveries within and outside of Germany the seller offers the following payment methods: 

  • Credit card (MasterCard, VISA)
  • PayPal
  • Sofortüberweisung 

In case of delivery to countries outside of Germany additional costs might occur, like taxes and/or duties or customs. The customer is responsible for paying any additional costs.

6. Warranty/Warranty for defects

The statutory warranty applies.

7. Storage of the contract information

The seller saves the contract information and sends them to the customer after the order has been processed. Additionally, the contract information is archived on the seller’s internet site. By logging on with his personal log in data the customer can see this information at any time.

8. Information on Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS).
